Mother pleads guilty, gets suspended sentence in 2-year-old’s death

NORFOLK, Va. (WAVY) — The mother of a 2-year-old girl who died in Norfolk last year got a suspended sentenced Wednesday after pleading guilty.

A spokesperson for the Norfolk Commonwealth’s Attorney’s Office said 26-year-old Destany Martin pleaded guilty to an amended charge of contributing to the delinquency of a minor — a misdemeanor.


Martin and her boyfriend, 25-year-old Robert Griffis, were both initially charged with felony counts of child abuse, child neglect and malicious wounding in the death of Evalynn Martin.

Evalynn died in May of 2017, just days after she was found unresponsive at a home on Lexington Street. Griffis lived with Martin at the home after he moved from Jacksonville to Norfolk.

Griffis was convicted of convicted of felony child abuse and malicious wounding following a three-day trial earlier this month. The jury recommended a sentence of 35 years in prison.

Destany Martin was sentenced Wednesday to 12 months in prison, with all 12 suspended. The time was suspended for two years conditioned upon uniform good behavior and completion of parenting classes.

Griffis will be sentenced at a later date.
