ISLE OF WIGHT COUNTY, Va. (WAVY) — A man charged in connection to the death of a 5-year-old Isle of Wight boy has entered a plea.
Commonwealth’s Attorney Georgette Phillips told 10 On Your Side Justin Cox entered an Alford plea for felony charges of child abuse – serious injury and involuntary manslaughter.
The plea means Cox does not admit guilt, but acknowledges that prosecutors had enough evidence for a conviction. A pre-sentence report has been ordered for March 19.
Cox was arrested last January after Levi Robertson was flown to Children’s Hospital of the King’s Daughters and placed on life support. The child’s mother, Jaye Hadley, was later arrested.
Charges against Cox and Hadley were upgraded to murder after Robertson passed away.
Hadley pleaded not guilty on Oct. 3 to charges of child abuse – serious injury and second-degree murder. Her trial was initially scheduled for Dec. 3, but was pupshed back to March 25.
