HAMPTON, Va. (WAVY) – Cory Bigsby, the father who has been indicted on charges in connection to the death of his 4-year-old son, Codi, was granted bond Wednesday morning and was released from jail later in the day.

Bigsby’s attorney, Amina Matheny-Willard, confirmed to 10 On Your Side that he was released from the Hampton Roads Regional Jail around 7:15 p.m. through a back entrance.

Earlier this month, Bigsby was charged with the murder of his son and the concealment of his body. The child’s body has yet to be found. Cory also faces dozens of child neglect charges not related to Cory’s disappearance.

10 On Your Side was in the courtroom when Bigsby was granted bond. Bigsby’s attorney, Amina Matheny-Willard, said the bond will total about $80,000 for all charges.

“He deserved a bond initially. Where he stands right now, he is not guilty of any crime,” said Matheny-Willard. “You’re innocent until you’re proven guilty. This is what is supposed to happen in this county.”

The judge said Bigsby will then be released on house arrest to his older daughter in Norfolk. There will be several conditions under this release, including that he can not have contact with his other young children who live out of state. He will also have a curfew and will not be able to leave the home unless it’s for a doctor’s appointment or court appearance.

Matheny-Willard asked the judge the seal Bigsby’s daughter’s name and address for fear of harassment.

Bigsby’s attorneys told the judge that the Commonwealth has not presented any evidence of murder and that there is no body, therefore he is entitled to bond.

Hampton Commonwealth’s Attorney Anton Bell told a judge Bigsby is a danger to the community with a history of going AWOL in the military.

Bell said evidence shows Cory killed his son. He believes Bigsby will continue to hide the body if released.

Two of Bigsby’s family members also took the stand to tell the judge that they will travel from Maryland to make sure he comes to court.

“We’re struggling for him to be here all this time and going through what he’s been through. But now this is a portion of relief. Lord, thank you for getting him out of that place, where they were really mentally trying to destroy him,” Cory’s uncle, Glenn Hinnant, told WAVY.

The judge said that Bigsby will not be released until he is given an electronic monitor.

A recently released mental health evaluation also reveals that Bigsby is competent to stand trial.

New court paperwork also alleges that Bigsby killed Codi around June 18, 2021, which is seven months before Bigsby reported Codi missing to the police.

During his first court appearance following the new charges, Circuit Court Judge James Hawks granted a competency hearing for Bigsby, which he says will likely be in late August.
